Terms of Service

These Terms of Service ("Terms") govern your use of the DriveWare software and any associated services provided by CelVak (the "Service Provider", "we", "us"). By using DriveWare, you agree to these Terms.

1. The software

DriveWare is a commercial product of CelVak. The source code is proprietary. Licensed components, when published, will be released under their own open-source licenses in separate public repositories.

2. Managed tiers (Cloud, Pro, Team)

Paid managed tiers provide cloud storage provisioned and billed by us. When you subscribe:

Billing: Payments are processed by Stripe. We do not store payment card details.
Term: Subscriptions are monthly and auto-renew until canceled.
Cancellation: Cancel at any time through your Stripe customer portal. Access continues through the end of the paid period.
Refunds: We offer a full refund within 7 days of your first subscription. No refunds after 7 days except where required by law.
Data: We will store your data in the cloud region(s) indicated at signup, encrypted at rest. We do not access your data except to provide the Service or when required by law.

3. Your responsibilities

Keep your install-kit credentials secure. We can rotate them if lost, but cannot recover encrypted data without them.
You are responsible for the content you store. Do not use DriveWare to store illegal content.
Back up your data independently. DriveWare is workspace storage, not your sole backup.

4. No warranty

DriveWare is provided "AS IS", without warranty of any kind. We do not guarantee uninterrupted availability, error-free operation, or preservation of data. Use at your own risk.

5. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of DriveWare shall not exceed the amount you paid to us in the twelve months preceding the claim, or USD $100, whichever is greater.

6. Termination

You may stop using DriveWare at any time. We may suspend or terminate access for users who violate these Terms, fail to pay, or use the Service unlawfully. If we terminate you for cause, we will provide reasonable opportunity to export your data before deletion.

7. Changes

We may update these Terms. Material changes will be announced on the DriveWare website at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.

8. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles.
